Terms and Conditions

Effective date: 26th August 2025

These Terms and Conditions (“Terms”) govern your access to and use of the Motor Connect Limited platform (“Portal”). By registering for and using the Portal, you agree to be bound by these Terms. If you do not agree, you must not use the Portal.

1. About Motor Connect

Motor Connect Limited provides an online platform primarily for Registered Motor Vehicle Traders (RMVTs) in New Zealand to list, buy, and sell vehicles. From time to time, access may also be granted to other participants in the automotive industry (such as wholesalers, finance companies, or service providers). All users are treated as business users, bound by these Terms, and acknowledge that this is a business-to-business (B2B) platform. Private sales and consumer transactions are not permitted, and the Consumer Guarantees Act 1993 does not apply.

2. Eligibility and Account Requirements

  • Access is restricted to verified RMVTs and, where approved by Motor Connect, other registered businesses in the automotive industry.
  • A screenshot or verification of RMVT status must be provided at sign-up. This will be checked against NZTA’s dealer database.
  • Accounts are non-transferable and may only be used by the verified dealership and its authorised staff.
  • You are responsible for maintaining account security and all activity under your account.
  • We reserve the right to decline, suspend, or revoke access at our sole discretion.

3. Subscription Fees and Payments

  • Subscriptions are billed per 30-day period from the date of payment. Your subscription will automatically renew every 30 days unless cancelled.
  • Payment is required in advance and provides access for the following 30 days.
  • All subscription fees are payable by credit card only, unless you have elected to pay an annual subscription, in which case payment must be made in full by invoice.
  • If you cancel your subscription, you will continue to have access until the end of your current 30-day period. No refunds will be issued for unused portions, except where required by law.
  • If a payment is declined, you will have a 7-day grace period to make payment. If payment remains outstanding, your account may be suspended or closed.
  • Fees are exclusive of GST unless otherwise stated.
  • We may adjust pricing with at least 30 days’ prior notice.
  • Multiple sites: One subscription is required per dealership site or yard. For example, if you operate two separate yards, each requires its own subscription. Enterprise subscriptions may be available by arrangement to cover multiple sites.

4. Use of the Portal

  • Listings must be accurate, lawful, and relate only to vehicles you are authorised to sell.
  • You must not upload or transmit any false, misleading, unlawful, defamatory, or harmful material.
  • Everything on the Portal must be used in good faith.
  • We may remove listings or suspend/terminate accounts that breach these Terms or New Zealand law.

5. Transactions Between Traders

  • All transactions occur directly between traders. Motor Connect:
  • Does not process or hold payments,
  • Does not guarantee vehicle condition, accuracy of listings, or deal completion,
  • Cannot return vehicles, reverse transactions, or refund payments.
  • Motor Connect has no responsibility for ensuring the validity, quality, or completion of any transaction.
  • Traders are responsible for their own due diligence.

Traders are solely responsible for their own due diligence. Vehicles are traded strictly on an “as is, where is” basis unless otherwise agreed between traders.


Because this is a B2B platform, the Consumer Guarantees Act 1993 does not apply.

6. Deal Commitments and Good Faith

  • If you agree to buy or sell a vehicle via the Portal, you are expected to honour that agreement in good faith.
  • Failure to complete a deal without valid reason may result in account suspension.
  • Repeat failures (“recidivist behaviour”), including repeated unsold cars after agreed deals, may result in permanent account termination with no refund for that month.
  • Motor Connect reserves the right to determine whether a failure is deliberate or valid.

7. Data and Privacy

  • Dealer information is stored on Digital Ocean servers, with appropriate security measures in place.
  • Personal information is collected only for verification and account purposes and will not be sold or shared with third parties.
  • In future, marketing or advertising features may be introduced (e.g., showing relevant trades to nearby dealers), but no personal data will be shared.

8. Termination of Access

  • You may cancel your subscription at any time; access will remain until the end of the billing cycle.
  • We may suspend or terminate your account immediately if you:
  • Breach these Terms,
  • Misuse the Portal, or
  • Fail to complete transactions in good faith.

9. Limitation of Liability and Disclaimer of Warranties

  • The Portal and all related services are provided on an “as is” and “as available” basis, without any warranties, representations, or guarantees of any kind, whether express or implied.
  • To the maximum extent permitted by New Zealand law, Motor Connect expressly disclaims all warranties, including but not limited to:
  • warranties of merchantability,
  • fitness for a particular purpose,
  • non-infringement, and
  • uninterrupted or error-free operation of the Portal.
  • Motor Connect does not warrant or guarantee the accuracy, quality, suitability, availability, or reliability of any listings, vehicles, services, or products made available through the Portal.
  • Traders are solely responsible for their own due diligence and for ensuring that any vehicle or service meets their requirements.
  • Nothing in these Terms limits or excludes any non-excludable rights you may have under New Zealand law.

10. Intellectual Property

  • All rights in the Portal (design, branding, code, content, workflows) remain the property of Motor Connect Limited or its licensors.
  • You may not copy, replicate, reverse-engineer, or create competing services from the Portal.
  • Confidential information accessed through the Portal must not be disclosed or misused.
  • We reserve the right to enforce our rights, including through legal action.

11. Force Majeure

Motor Connect will not be liable for any delay or failure to provide access to the Portal due to events beyond its reasonable control, including but not limited to natural disasters, IT or hosting failures, cyber-attacks, labour disputes, or government actions.

12. Governing Law

These Terms are governed by New Zealand law. Any disputes must be resolved exclusively in the courts of New Zealand.

13. Changes to These Terms

  • We may update these Terms from time to time.
  • Material changes (such as pricing) will be provided with 30 days’ notice.
  • Continued use of the Portal after updates constitutes acceptance of the revised Terms.
